Obtaining the Tax Identification Number (TIN)
To purchase a property in Portugal, since this process is subject to the payment of taxes, it is necessary to register with the Tax Administration in order to obtain the respective tax identification number.
You can obtain the same at any service counter of the Tax and Customs Authority, or at the counters of citizen stores that provide this service.
CPCV (purchase and sale promise contract)
The CPCV is a legal document that, although it is not mandatory for the purchase or sale of a property, it safeguards the rights and duties of both parties involved in the deal until the final contract - Public deed of purchase and sale.
Among the advantages inherent to this contract, it is worth mentioning the speed of formalization of a binding document between the seller-seller and the buyer-seller, making the date of the future transaction official, its conditions and agreed values.
The amount given as a down payment on the CPCV usually varies between 10 and 20% of the asset being sold.
Before starting the process of buying your new property, you must pay attention to all the legal documentation regarding the property, as well as the legitimacy of the seller. In the following list we present the documents to be taken into account:
1. Caderneta Predial - Document issued by the Tax and Customs Authority, which includes, among others, the following data: the identification and location of the property, the areas of the property, the tax equity value (for tax purposes), information on any exemptions and the holders, depending on the situation.
2. Certificate of Land Registry (or content certificate) - Document issued by the Land Registry Office that contains information on: the location and composition of the property, the owners, if any onus or burden falls on the property (mortgage, attachment, easements) , usufruct, etc ...).
3. Use License - Document issued by the Municipality where the property is located, which certifies that the property has been inspected and is in the conditions required by law to be inhabited. In the case of a building construction prior to 1951, this document is not mandatory.
4. Energy certificate - Document issued by technicians authorized by ADENE (National Energy Agency), which assesses the energy efficiency of a property on a scale from A + (very efficient) to F (inefficient).
5. Housing technical sheet - Document describing the main technical and functional characteristics of a property. It is mandatory for properties that have undergone reconstruction, expansion or alteration after March 30, 2004.
6. Declaration of no debt to the condominium - If you intend to acquire a property that is inserted in a building under a horizontal ownership regime, you can request this document from the owner, in order to ensure that there are no debts to the condominium until that date.
In addition to the documents referred to above, the following documents are still required for the deed:
Salesman:
- Civil and tax identification documents
- Bank termination (If mortgage is registered)
- Declaration of exercise of the preemptive right (If applicable)
Buyer:
- Civil and tax identification documents
- Proof of IMT payment
- Proof of payment of Stamp Duty
- Bank check for the remaining amount, to the owner's order
